Mobile, Alabama -- Mobile attorney Jim Zeigler has requested a delay in a vote by the Gulf Council on a proposal to reduce the red snapper fishing season to eleven days. With the proposal likely set for a Thursday, April 10 vote, Zeigler told the council there was not enough public notice and input. He asked for a delay so that fishermen and others can comment on the proposal.
Zeigler says the 11-day season would be devastating for recreational fishermen, of which he is one.
Zeigler says the long-run solution to this problem is remove federal regulation of our fisheries. Put management back under Alabama control.
Federal management of our fishery has been just awful, Zeigler added.
Here is the request filed April 9 by Zeigler:
BEFORE THE GULF OF MEXICO FISHERY MANAGEMENT COUNCILWritten Statement in Opposition to the 11-day Red Snapper Season for Alabama: Request for Delay in Decision
I am asking the Gulf Council to postpone its scheduled vote on the proposed 11-day red snapper season for Alabama recreational fishing. Since the 11-day season proposal has just been publicized and I just found out about it, please waive the suggested three days before the start of the Council meeting for submission of this written comment.
The proposed change from a 40-day season to an 11-day season would be a devastating change for Alabama s recreational anglers. Because of the timing of the court decision, there has not been adequate notice to the public and to Alabama public officials. Please do not make a final decision on this on April 10, 2014 and recess the meeting for a reasonable period to allow public notice and input. Please postpone a vote until after such notice and input period.
This vote comes only about three days from the general public s finding out about the 11-day proposal. An April 10 vote will not allow adequate notice and public input. It would certainly give the appearance of unfairness if not an actual denial of procedural due process.
Brief description of my Background and Interest in this Matter
I am an angler. I have a lifetime fishing license, including saltwater fishing, from the State of Alabama. I go red snapper fishing.
I am also the attorney for Save Our Mobile/Tensaw Delta, a group of citizens and outdoors-lovers who organized to maintain state control of our Delta and prevent federal management takeover and prevent nationalization.
I am asking the Council to not proceed now with approve the proposed 11-day season for red snapper for recreational anglers in Alabama. This short of a season will be devastating for recreational fishermen and the hundreds whose livelihoods will be affected. I ask for at least a postponement and re-notice to the public.
